Terms of Service

These Terms of Service ("Terms") govern the website design and related services provided by RC Marketing and Design, represented publicly by the alias "799 Web" ("799 Web," "we," "us," or "our") to you ("Client," "you," or "your"). 799 Web is the public-facing trade name for RC Marketing and Design. By reserving a build, paying any fee, or otherwise engaging our services, you agree to these Terms.

1. Services

RC Marketing and Design, operating publicly as 799 Web, provides custom website design and build services on a productized, flat-fee basis. Our standard build ("Build") includes:

  • A custom-designed website of up to fifteen (15) pages
  • Mobile-responsive layout
  • Basic local search engine optimization (SEO) setup
  • Initial hosting configuration
  • Two (2) rounds of revisions during the production period (see Section 4)

Additional features, page counts, e-commerce functionality, custom web applications, and any add-on services are not included in the standard Build and are quoted and billed separately.

2. Fees and Payment

  • Total standard Build price: $799 (US dollars), unless a different amount is agreed in writing for a custom scope.
  • Booking fee: $300, paid to reserve your production slot (see Section 3).
  • Remaining balance: $499, due before production begins (see Section 5).
  • Monthly maintenance: three tiers — Essential ($25/month), required to keep the site live; Growth ($100/month), unlimited small edits; Scale ($225/month), ecommerce, CRM, and custom web-app support. Billed in advance, beginning at launch (see Section 8).
  • Add-ons: billed at the prices quoted at the time of purchase.

All fees are payable through our third-party payment processor. You are responsible for any taxes applicable to the services.

3. Booking Fee — Non-Refundable

The $300 booking fee is non-refundable. It secures your production slot and pays for your strategy consultation and the preparation work we begin on your behalf immediately upon payment.

  • The booking fee is credited in full toward your total Build price. It is part of the price, not an additional charge.
  • Because the booking fee compensates work that begins right away and reserves capacity we could otherwise offer to another client, it is non-refundable for any reason, including if you later decide not to proceed, become unresponsive, or cancel.
  • If you cancel or become unresponsive before paying the remaining balance, you forfeit the booking fee and we are released from any obligation to perform further work.

4. Scope, Revisions, and Change Requests

  • The standard Build is limited to the deliverables listed in Section 1.
  • "Revisions" means adjustments to the design and content of pages already within scope. The Build includes two (2) rounds of revisions during the production period.
  • The following are out of scope and, if requested, will be quoted and billed separately before any additional work begins: additional pages beyond fifteen; full redesigns after a revision round is approved; new features or functionality; e-commerce; custom applications; third-party integrations; copywriting beyond light editing; logo or brand identity design; photography; and ongoing content creation.
  • "Small edits" available under monthly maintenance (Section 8) means minor content and image changes to an existing, launched site, and is included only on the Growth and Scale tiers. The Essential tier covers hosting, backups, security, and minor tech fixes only, and does not include ongoing content edits. No tier includes new pages, redesigns, or new features.
  • We will confirm any out-of-scope work and its price in writing, and will not proceed with it until you approve.

5. Production Timeline — "5 Days from Kickoff"

  • Our advertised delivery of five (5) business days runs from Kickoff, not from the date you pay the booking fee.
  • "Kickoff" occurs only when all of the following are complete: (a) your strategy consultation has taken place; (b) you have provided all content and materials we request (including but not limited to logo, images, text, business information, and access credentials); and (c) the remaining balance has been paid in full.
  • If any required item is outstanding, the timeline does not begin, and if items are delayed after Kickoff, the timeline pauses until we receive them. Delays caused by you, by third parties, or by circumstances outside our reasonable control do not count against the delivery window.
  • "Business days" means Monday through Friday, excluding U.S. federal holidays.

6. Client Responsibilities

You agree to:

  • Provide accurate, complete, and lawful content and materials in a timely manner.
  • Respond to requests for feedback, approvals, and information promptly.
  • Hold all necessary rights to any content, images, logos, or materials you provide, and grant us the right to use them to perform the services.
  • Review and approve work at each revision stage.

If you do not fulfill these responsibilities, we may pause or suspend work, and the timeline and our obligations are adjusted accordingly. Prolonged non-responsiveness (see Section 7) may result in project closure.

7. Client Non-Responsiveness and Abandonment

If you become unresponsive for fifteen (15) consecutive days after Kickoff or after a request for information or approval, we may, at our discretion, treat the project as abandoned. In that case:

  • All fees already paid are non-refundable, including the remaining balance if paid.
  • We are released from any further obligation.
  • Resuming the project later may require a new booking fee and re-quoting, subject to availability.

8. Monthly Maintenance and Hosting

Ongoing maintenance and hosting are offered on three tiers, each billed monthly in advance:

  • Essential — $25/month. Hosting, daily backups, SSL, security patches, uptime monitoring, and minor technical fixes. This is the minimum required to keep your website hosted and live.
  • Growth — $100/month. Everything in Essential, plus unlimited small content edits (as defined in Section 4) with priority turnaround.
  • Scale — $225/month. Everything in Growth, plus ongoing support for ecommerce storefronts, CRMs, custom web applications, and third-party integrations. Major new features remain out of scope and are quoted separately.
  • An active maintenance subscription (at least the Essential tier) is required to keep your website hosted and live. If you cancel maintenance entirely, your site will be taken offline, and we are not obligated to continue hosting, storing, or maintaining it.
  • You may upgrade, downgrade, or cancel your tier at any time, effective at the end of the current billing period. Fees already paid for the current period are non-refundable.
  • We do not provide refunds for partial months.

9. Intellectual Property

  • Upon full payment of all amounts owed (Build price plus any add-ons), you receive a license to use the completed website for your business.
  • Until full payment is received, all work product, designs, code, and files remain the sole property of RC Marketing and Design, operating as 799 Web, and you have no right to use, copy, or deploy them.
  • You retain ownership of the content and materials you provide to us.
  • We may display the completed website and describe the work in our portfolio and marketing unless you request otherwise in writing.
  • Any underlying frameworks, tools, code libraries, and reusable components we use or develop remain our property and may be reused on other projects.

10. No Guarantee of Results

We build websites designed to help your business. However, we do not guarantee any specific business outcome, including but not limited to increased traffic, leads, sales, customers, search-engine rankings, or revenue. Such outcomes depend on many factors outside our control. Any marketing statements about what a website is "built to" or "designed to" do are descriptions of intent, not guarantees of results.

11. Limitation of Liability

To the maximum extent permitted by law:

  • Our total aggregate liability to you for any and all claims arising out of or relating to the services or these Terms shall not exceed the total amount you actually paid to us for the specific Build giving rise to the claim.
  • We are not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost business, or lost data, even if advised of the possibility.
  • We are not responsible for failures, outages, downtime, data loss, or damages caused by third parties or third-party services, including but not limited to hosting providers, payment processors, domain registrars, plugins, and platform outages.
  • The services are provided "as is" and "as available," without warranties of any kind except as expressly stated in these Terms.

12. Indemnification

You agree to indemnify and hold harmless RC Marketing and Design, 799 Web, and its owner from any claims, damages, liabilities, and expenses (including reasonable attorney's fees) arising from: (a) content or materials you provide; (b) your violation of any law or third-party right; or (c) your breach of these Terms.

13. Third-Party Services

Our services rely on third-party providers (hosting, payment processing, domain registration, and similar). Your use of those services may be subject to their own terms. We are not responsible for the acts, omissions, pricing changes, or availability of third-party providers.

14. Chargebacks

Because the booking fee and other fees pay for work performed and capacity reserved, initiating a chargeback or payment dispute in violation of these Terms is itself a breach. We reserve the right to contest any wrongful chargeback and to recover related costs.

15. Termination

We may suspend or terminate services if you breach these Terms, fail to pay, or become unresponsive. Fees already paid are non-refundable as described above. Sections that by their nature should survive termination (including Sections 3, 9, 10, 11, 12, and 16) survive.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in Spokane County, Washington, and you consent to that jurisdiction.

17. Changes to These Terms

We may update these Terms from time to time. The version in effect at the time you engage our services governs that engagement. Continued use of ongoing services (such as maintenance) after an update constitutes acceptance of the updated Terms.

18. Entire Agreement

These Terms, together with any written quote or order you approve, constitute the entire agreement between you and RC Marketing and Design, operating publicly as 799 Web, and supersede any prior discussions or representations. If any provision is found unenforceable, the remaining provisions remain in effect.
